    With 1 in 5 U.S. adults experiencing some form of mental illness each year (according to the National Alliance on Mental Illness) and an increasing number of organizations implementing initiatives to support employee mental health, it is important for employers to understand the legal considerations they should be aware of. In this presentation, Chris Morgan will discuss a range of employer responsibilities when it comes to employee mental health in the workplace. In addition to many mental health conditions being protected by the Americans with Disabilities Act (“ADA”), the Family Medical Leave Act (“FMLA”), and various leave and accommodation laws, this presentation will delve into some of the more complicated issues for employers.

    Learning objectives will include the following:

    1. When does a mental health issue qualify as a disability?
    2. What laws protect employees with mental illness?
    3. What are considered reasonable accommodations for employees whose mental health illnesses qualify as disabilities?
    4. What medical information can an employer require to substantiate a request for reasonable accommodation? Does a note from a social worker count?
    5. Can work-related stress or anxiety trigger a workers’ compensation claim?

    Chris Morgan is a partner at Barran Liebman LLP, where he specializes in complex employment advice, strategy, and litigation. Chris is known for his aggressive defense of a wide range of employment-related claims—including those alleging wrongful termination, harassment, discrimination, and wage and hour violations. He represents employers of all sizes and industries in state and federal courts, as well as in front of regulatory agencies such as BOLI and the EEOC. In addition to his litigation experience, Chris is a frequent speaker, author, and adviser in a variety of media. He is passionate about helping businesses succeed, and provides interactive trainings and advice on topics related to management, employment law, legal policy, and compliance. He is also actively involved in the community, currently serving as an Ambassador Board Member for the First Tee of Portland. Chris graduated, cum laude, with a B.A. in Political Science from Washington State University and earned his J.D. from Gonzaga University School of Law where he received the highly regarded Dean’s Distinguished Achievement Scholarship and represented his class as the Commencement Speaker.
